This Privacy Policy applies to information we collect when you use our websites, mobile applications or other online or mobile products and services (collectively, the “Services”).

If we make changes, we will notify you by revising the “Last Updated” date at the top of the policy, and, in some cases, we may provide you with more prominent notice (such as by adding a statement to our homepage or sending you an email notification). Collection of Information

Information You Provide to Us

We collect information you provide directly to us. For example, we may collect information when you submit waiting list request, subscribe to text message updates, participate in contests, promotions or surveys or otherwise communicate with us. 

The types of information we may collect include contact information (such as name, postal address, company name, email address and phone number), demographic information (such as age, date of birth and gender), government identification information (such as driver’s license number), employment information (such as current occupation and employment history) and other contact or identifying information you choose to provide.

We use information collected through our Services for purposes described in this Privacy Policy or otherwise disclosed to you in connection with our Services. For example, we may use your information to: 

• Communicate with you about our or other companies’ products, services, offers, promotions, rewards, and events and provide other news and information about TutorId and other companies with which we partner; 
• Provide, maintain and improve our Services;
• Provide and deliver the products and services you request, process transactions, and to send you related information, including confirmations and invoices; 
• Send you technical notices, updates, security alerts and support and administrative messages;
• Respond to your comments, questions and requests and provide customer service;
• Monitor and analyze trends, usage and activities in connection with our Services; 
• Personalize and improve your experience on the Services and provide ads, content, or features that match user profiles or interests; 
• Process and deliver contest entries, rewards and surveys;
• Process and evaluate your application for employment; and

TutorId is based in Estonia and the information we collect is governed by European law. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to Europe.

We may share personal information about you as follows or as otherwise described in this Privacy Policy:

• With other companies with which we partner for their direct marketing purposes.
• With vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
• In connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture, or dissolution of all or a portion of our business;
• In response to a request for information if we believe disclosure is required by, or is in accordance with, any applicable law, regulation or legal process.

The Services may offer social sharing features and other integrated tools (such as the Twitter “Tweet” button), which let you share actions you take on our Services with other media. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. If you use the message boards, chat rooms, comment tools, or other public forums of the Services, you will be publicly identified by the user name, nickname, or other content you submit. All information you provide on these public forums will be viewable by the general public. We cannot be responsible for any personal or sensitive information you choose to post on public forums and we recommend careful consideration before you post such information. You agree that you will not disclose personal or sensitive information relating to any other person in a public forum of the Services without that person’s prior, express consent.

We may allow others to serve advertisements on our behalf across the Internet and to provide analytics services. Your Choices

Promotional Communications

You may opt out of receiving promotional emails or text messages from TutorId by following the instructions in those emails or text messages. If you opt out, we may still send you transactional or relationship messages, such as emails or text messages about our ongoing business relations.

Push Notifications

With your consent, we may send push notifications to your mobile device to provide information related to Services, service updates, promotional communications and other related messages. You can deactivate these notifications by changing your notification settings on your device.

Location Information

If you initially consent to our collection of location information via one of our mobile applications, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. If you do so, certain features of our mobile applications may no longer function. You may also stop our collection of location information by following the standard uninstall process to remove all of our mobile applications from your device.

Cookies; Web Beacons

Some web browsers incorporate a "Do Not Track" feature that signals to websites that you visit that you do not want to have your online activity tracked. Please note that we do not interpret or respond to "Do Not Track" signals. However, you can usually choose to set your browser to remove or reject cookies and web beacons. By accessing Tutor.id website found at www.tutor.id and www.tutorid.com, whether through a mobile device or computer (collectively, the “Service”) you agree to be bound by these Terms of Use (this “Agreement”), whether or not you create a Tutor.id account. If you wish to create a Tutor.id account and make use of the Service, please read these Terms of Use. TutorId Limited is a registered company in Ireland and support operations around the world.

Changes to the Website

You acknowledge and accept that we may from time to time alter, suspend or discontinue any aspect of the Website or the Content available through it and you will be notified at every change.

Further, we may alter the Terms from time to time. If we do so, the updated version will be effective as soon as it is uploaded on to this site. We recommend that you revisit this page at every change of our terms of use to ensure that you are aware of any changes that we have made to these Terms. By continuing to use the Website following any amendments to the Terms, you indicate your agreement to such amendments.

You accept that you will have no claim for breach of contract or otherwise in respect of any such alterations to the Website or these Terms.

Your Eligibility and Usage

You agree and acknowledge that:

• in order to register as a Tutor, be eligible to receive payments and offer tutoring services you must register and create an account and warrant to us that you are 18 or older.
• in order to register as a Student you should warrant us that you are 18 or older. If the Student is under 18, the legal responsible must register and create and account for the student as well as managing the account. The underaged student under no circumstances should use the account & application even with parental permission.
• you can register to join the Service as a Tutor by logging into your Account using certain third party social networking sites (“SNS”) (including, but not limited to Facebook) via our Site. When you register by logging into an SNS via our Site, we will obtain the Personal Information you have provided to that SNS (including, but not limited to your “real” name, profile picture, email address, list of SNS friends and any other information that you make available via the applicable SNS) from the account you have with such SNS and use that information to create your account and you will become a User; the information we obtain may depend on the information you provide to the applicable SNS and/or the privacy settings you have set or applied with the applicable SNS.
• You are responsible for safeguarding and maintaining the confidentiality of your username, password and corresponding Account information. You agree not to disclose your password to any third party and that you are entirely and solely responsible for any and all activities or actions that occur pursuant to the use of your Account, whether or not you have authorised such activities or actions. You will immediately notify Tutor.id at [email protected] of any unauthorised use of your username, password or Account and we will immediately send you a password reset link.
• You agree that you will not permit, enable, introduce or facilitate: (i) persons who do not have an Account to have access to the features of the Site and Services only made available to registered Tutors; and (ii) other persons to participate in providing Tutor Services from your Account.

Your Conduct

You warrant that in your use of the Website you shall:

• use the Website only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use of the Website by any third party; and
• not engage in any conduct which is unlawful, or which may harass or cause distress or inconvenience to any person.
• not impersonate another person or allow any other person or entity to use your username, password or membership.
• agree that the relationship between you and Tutor.id is that of an independent contractor and nothing in Tutor.id Terms of Service may be construed as establishing an employment or agency relationship between you and Tutor.id.
• acknowledge and agree that you are not and will not be entitled to any benefits paid or made available by Tutor.id to its employees, including, without limitation, any vacation, sick leave or similar pay or benefit, or to participate in any plans, arrangements or distributions made by Tutor.id pertaining to any bonus, stock option, profit sharing, insurance or similar benefits, whether available to employees of Tutor.id or otherwise.

For Tutors: Accept Payments, Charges & Refunds

You acknowledge and agree that:

• accepting cash payments is solely responsibility of the user (tutor) who made an account. Tutor.id holds no responsibility in guaranteeing cash payments from students.
• accepting card (online) payments is the only guaranteed payment method and it is only possible by connecting to Stripe.
• we grant the amount of five free bookings monthly (meaning you must accept 5 booking requests) as free trial, however to accept higher number of bookings per month you must purchase any of the available paid subscription plans.
• the subscription service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for unused months with an open account.
• if you choose to save your details when paying for Tutor.id services (use of platform and all its features), Tutor.id reserves the right to take payment for invoices from that card. We only charge you in case you have chosen a paid subscription package.
• all payments are to be made according to the currency of your country of residence.

For Students: Charges & Refunds

You acknowledge and agree that:

• the student pay no subscription fee to access the selected tutor on Tutor.id
• Tutor.id will only display the preferred tutor’s booking and cancellation policies, as well as their availabilities - tutors are independent contractors that make use of the application to manage their business.
• accepting to pay your tutor in cash is solely a responsibility of the user who made an account. Tutor.id holds no responsibility in guaranteeing cash payments from students.
• tutor can cancel the class at any time and you will not be charged by the lesson.
• the refund request will be sent directly only if authorised by the tutor (e.g. if tutor did not attend a lesson booked).
• if the student is not satisfied with the teacher or class there are no refunds based on customer dissatisfaction.

Disclaimer and Limitation of Liability

You should not rely on the accuracy of any part of the Content. You accept and acknowledge we shall not in any way be liable for any damage, loss, costs or expenses arising directly or indirectly from your reliance on or use of any of the Content for any purpose.

Whilst every effort is made to ensure that the Website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to or loss of data on your computer system, network or server that results from the download or use of the Website or any Content made available via the Website.

Without affecting the above statements, and except as expressly stated in these Terms, we disclaim, as far as the law allows, all warranties and representations, express or implied, in respect of any of the Content, including but not limited to warranties of satisfactory quality, fitness for a particular purpose, non-infringement of third party rights or any law, compatibility, security and accuracy.

We accept no liability for any indirect or consequential loss or damage or for any loss of data, profit, business, revenue or anticipated savings (whether direct or indirect) that arise out of or that are related to the use of this Website.

Nothing in these Terms shall exclude or limit (i) our liability for death or personal injury caused by our negligence; or (ii) any liability that cannot be limited or excluded by law.

Downtime

You acknowledge and accept that computer and telecommunications systems may contain faults, including viruses, and may from time to time require periods of downtime (being periods during which the Website is not available to you) for the purposes of repair, maintenance and upgrading.

Accordingly, we do not guarantee uninterrupted availability of the Website, but we shall make reasonable efforts to minimise any periods during which the Website is not available. You accept that you shall have no claim for breach of contract or otherwise in respect of any such period of unavailability.

The Website and its Content may at points incorporate links to the websites and services of third parties. Any such use is prohibited and will constitute an infringement of the copyright and other intellectual property rights of ours, or in the case of material licensed to us, the owner of such materials.

Permission is given for the downloading and temporary storage of one or more of these pages for the purposes of viewing them on a personal computer or monitor for your own personal and private use. These pages may also be printed for your personal, private and non-commercial use provided that you make no alteration to any of the Content and you do not use any part of the Content in any other publication, in whatever medium, without the prior written consent of Tutor.id.

The Tutor.id trade mark, the www.tutor.id or www.tutorid.com domains and any other names, images or logos identifying Tutor.id and our products and services are either (a) proprietary marks of ours or (b) marks which we are licensed to use. Dispute Resolution

You and Tutor.id agree that any dispute, claim or controversy between you and Tutor.id, or otherwise arising out of or relating to these Tutor Terms of Service or the breach, termination, enforcement, interpretation or validity thereof or the use of the Site or Services (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.
